There has been a rise in “silver splitters”, but those divorcing in their later years are forced to grapple with antiquated laws that share out their pension pots exactly down the middle. 

Pensions take decades of steady saving to build, so it is not surprising that splitting lifetime savings can be contentious. Legal reforms may soon make these disputes a thing of the past, but for now, courts are allowed to split assets that were accumulated before, as well as during, the marriage.
